Receipt of the grounds for the appeal on points of law
On 06.12.2024 I finally received by post a copy of the grounds for the appeal on points of law (Revision)The grounds for the appeal on points of law against the judgment of 22.07.2024, submitted by court-appointed defence counsel on 28.11.2024. from my lawyer. On reading it, however, I found that essential arguments crucial to the appeal on points of law were missing, significantly reducing its prospects of success. I had effectively been excluded from the entire preparation process; my objections and legal arguments were completely ignored.
Commentary — Dmitry Bagrash’s assessment
The copy reached me eight days after the deadline expired. This made it clear that changes to the grounds could no longer be made through defence counsel, but only as a supplement recorded by the court registry. § 344 Abs. 2 StPO sets no new deadline for such supplements. It was precisely these supplements that I was prevented from submitting from 15.01.2025 onwards — the following pages document this.
