Receipt of opened letters
On 03.04.2025 I received two letters: one with a return receipt and one from defence counsel. The defence correspondence had been opened. However, the documents relevant to the appeal on points of law are still missing.

Correspondence with defence counsel is unrestricted and exempt from inspection under § 148 StPO. An opened letter from defence counsel is therefore legally different from an opened private letter: it directly affects the right to a defence. The point that matters to me is that the documents relevant to the appeal on points of law were missing at the same time.
