Emergency submission of both my constitutional complaints
From 19.06.2025 to 20.06.2025 I submitted both constitutional complaints to the Bundesverfassungsgericht (Federal Constitutional Court) by fax as an emergency measure and within the time limit — each including an application for an interim order. They challenged the order of the Bundesgerichtshof (Federal Court of Justice) of 07.05.2025 (Az. 5 StR 72/25). (Anlage_57_F2_VB_Sendebericht); (Anlage_57_1_F2_VB_Sendebericht)
Collection of fax transmission reports of 20. and 21.06.2025 (recipient: “INTAMT”, fax number 0721 9101-382, corresponding to the fax number of the Bundesverfassungsgericht).
The transmission reports document several successful fax transmissions (each with status “OK”) to the fax number of the Bundesverfassungsgericht over the entire period from 20.06.2025, 00:35, to 22.06.2025, 22:13, with transmission durations between 12 and 73 minutes and page counts between 14 and 80 pages per transmission — corresponding to the length of both complete constitutional complaints with annexes and the applications for interim orders.
Commentary — Dmitry Bagrash’s assessment
Submission by fax on the last day was an emergency measure after the postal route had not been secured. Both constitutional complaints challenged the order of the Bundesgerichtshof of 07.05.2025 — thus a decision based on a judgment without a list of legal provisions. The chain of provisions was not added until 30.07.2025.
