Delayed handover of the draft appeal on points of law (Rechtsbeschwerde)

Anton Malkin sent me at Heidering prison (JVA Heidering), by registered mail RT508494813DE, the complete draft he had printed of my appeal on points of law (Rechtsbeschwerde), subject to a procedural time limit, against the order of Berlin Regional Court I (Landgericht Berlin I) of 31.07.2026 (case reference 595 StVK 68/26 Vollz). Deutsche Post tracking showed delivery on Wednesday, 19.08.2026 (Annex 161_F2). A return receipt also available confirms: “The item was delivered on 19.08.2026” — person accepting it: “Wendland”, with a signature (Annex 174_F2).

On 20.08.2026, I personally asked the responsible social worker, Ms Mahlow, about the item and pointed out that its contents were subject to a procedural time limit; she stated that she knew nothing about it. Despite documented multiple interventions on 21.08.2026 with the court, JVA and Petitions Committee (see No. 184), the item was initially not handed over.

I finally received it on 24.08.2026 at 17:30 — opened. The receipt date was initially missing from the receipt journal; at my request, the staff member entered 24.08.2026. In her presence, I wrote “Received 24.08.2026” on the envelope and signed it. A scan of the envelope will be supplied later.

The delay was particularly significant because of the deadline for the appeal on points of law (Rechtsbeschwerde), expiring on 11.09.2026, and the formal requirement of § 118 para. 3 StVollzG: five days between proven delivery and actual handover, against a deadline that does not forgive delay.

Commentary — assessment by Dmitry Bagrash

Only the internal route within the JVA following the proven acceptance by the person “Wendland” on 19.08.2026 remains to be clarified. Delivery itself is evidenced twice — by online tracking and by an individualised return receipt. What is unresolved is therefore not the item’s arrival within the JVA’s sphere of responsibility, but only what happened internally in the five days that followed.
