Political prisoner, complaint filed with the EGMR (European Court of Human Rights), facing deportation. Unprecedented resistance from the Berlin prosecution service is to be expected. The lawyer must be based outside Berlin.
Details →Petition E-208090 submitted to the German Bundestag (Deutscher Bundestag)
Submitted via the Petitions Committee’s online form (Petitionsausschuss) and registered under number E-208090. It requests, first, an addition to § 260 Abs. 5 Satz 1 StPO so that the mandatory list of criminal-law provisions applied can no longer be added after the decision has become final and after the ruling on the appeal on points of law (Revision); second, clarification of how the Bundestag ensures that exercising the rights to petition it and express opinions to it does not lead to disadvantages in prison.
The petition expressly makes clear that a review of the petitioner’s own criminal proceedings is not requested.
Commentary — assessment by Dmitry Bagrash
The Petitions Committee of the Bundestag (Petitionsausschuss des Bundestages) no longer has a fax connection, and I cannot send items by post from custody. The online form was the only route available to me. E-208090 is therefore the first petition addressed to the Bundestag whose receipt is technically evidenced.
According to the Committee’s instructions, supplementary documents are to be sent by post only after the file reference is received. Until then, I refer to the documentation.
