Application to discharge my lawyer from his duties as defence counsel, recorded by the court registry
On 17.12.2024 I applied for my lawyer to be discharged from his duties as defence counsel because of the breach of trust (Anlage 5_F2)
Commentary — Dmitry Bagrash’s assessment
First official response: on 21.05.2025 I received a response from a court for the first time — the order of the BGH (Federal Court of Justice) dated 07.05.2025
JVA Moabit (Moabit Prison), Rechtsantragstelle (office for recording legal applications). Mr Bagrash, Dmitry, register no. 2796/22/6, appeared at the office for recording legal applications at JVA Moabit and stated: 17.12.2024.
I wish my current lawyer, Mr Bernd Römer, to be discharged from his duties as defence counsel. In a letter of 16.12.2024, I already informed my lawyer that I was terminating the mandate and revoking my power of attorney. I also apply for lawyer Römer to hand over to me all documents relating to my proceedings.
Reasons
It was no longer possible for me to establish adequate contact with my lawyer. Since the pronouncement of judgment, I was able to contact him only twice. I received the copy of my lawyer’s grounds for the appeal on points of law (Revision) only on 06.12.2024. By that time, the deadline for submitting grounds had already expired. I was therefore unable to supplement the grounds for my appeal.
This resulted in a breach of trust.
