Request for assistance submitted to the Bundesjustizministerium (Federal Ministry of Justice)

On 17.02.2025 I submitted an urgent request for assistance to the Bundesministerium der Justiz (Federal Ministry of Justice), after my complaints at state level had remained unanswered. (Anlage 17_F2)

Dmitry Bagrash, Alt-Moabit 12a, 10559 Berlin — To the Bundesministerium der Justiz, Mohrenstraße 37, 10117 Berlin. Berlin, 17.02.2025.

Subject: Urgent complaint and request for assistance concerning systematic violations of law in my criminal proceedings (case reference: 522 Ks 5/23; 176 Js 4/22) — Landgericht Berlin (Berlin Regional Court).

Dear Sir or Madam, I am approaching the Bundesministerium der Justiz at federal level because my previous complaints at state level have remained unanswered. Despite repeated submissions, I have received no acknowledgement of receipt of my application for an interim order made to Kammergericht Berlin (Berlin Higher Regional Court) on 03.02.2025. Moreover, my criminal complaint filed in January 2024 against Criminal Police Commissioner Weiß for knowingly false statements has not been dealt with to date.

I. Facts: systematic violations of law

1. Obstruction of the appeal on points of law and refusal to acknowledge receipt: My supplement to the grounds for the appeal on points of law (Revision) was submitted on 20.01.2025, but to date I have not been issued an acknowledgement of receipt under § 37 StPO. There are indications that forwarding it to the court hearing the appeal was deliberately blocked, in particular by Groß, Presiding Judge at the Landgericht (VRiLG). In a letter without a prescribed form of 12.12.2024, he falsely asserted that the deadline had already expired.

2. Unlawful refusal of access to the case file: My application for access to the case file of 10.12.2024 was rejected on the grounds that the file was “no longer at the court”. On 15.01.2025 I was refused acceptance of my supplement to the grounds for the appeal on points of law at Amtsgericht Tiergarten (Tiergarten Local Court) on direct instructions from VRiLG Groß.

3. Unlawful isolation: My contact with the Jewish community was unlawfully blocked for 116 days, although it is a state-recognised religious community governed by public law. All access to independent lawyers was deliberately prevented.

4. Manipulation of the proceedings: My proceedings were conducted using false facts and manipulated presentation of evidence. There is a suspicion that documents were removed from the investigation file or tampered with.

II. Political dimension

My criminal prosecution is directly connected with my political work against Russian influence in Germany. My banner “Putin is a Killer” had previously been unlawfully confiscated at a demonstration.

III. Violations of legal provisions

§§ 344, 345 StPO; Art. 6 Abs. 3 EMRK; Art. 103 Abs. 1 GG; §§ 258a, 339 StGB; § 37 StPO; Art. 19 Abs. 4 GG, Art. 13 EMRK.

IV. Requests

1. Investigation of the systematic violations of law by VRiLG Groß and Senior Public Prosecutor Wachs. (OStA) 2. Ensuring that my supplement to the grounds for the appeal on points of law is forwarded without delay and an acknowledgement of receipt is issued. 3. An order for an independent review of my criminal proceedings. 4. Initiation of an investigation against VRiLG Groß for obstruction of prosecution in public office and perversion of justice (Rechtsbeugung). 5. Examination of the influence of external political interests. 6. Measures against my unlawful isolation.

V. Announcement of an application to the EGMR: I will also lodge an application with the EGMR (European Court of Human Rights) under Art. 6 and Art. 13 EMRK.

Yours sincerely, Dmitry Bagrash

Commentary — Dmitry Bagrash’s assessment

The Bundesministerium der Justiz was the first body outside Berlin that I approached. This episode belongs among the submissions that received no substantive reply. In assessing the case, what matters is not the individual failure to issue a decision but the pattern: state level, federal level, supervision, parliament — the same lack of response each time.
