Personal appeal to Berlin’s Senator for Justice, Dr. Felor Badenberg
Also on 24.04.2025, I address a personal appeal to Berlin’s Senator for Justice, Dr. Felor Badenberg. In it, I urgently ask her to take personal responsibility for clarifying my case and to work towards an immediate end to systematic deprivation of rights, disregard for fundamental rights, isolation and intimidation. (Annex 36_F2)
All responses from the Senate Department for Justice are in Annex 56_F2.
Dmitry Bagrash, Alt-Moabit 12a, 10559 Berlin — To Berlin’s Senator for Justice, Dr. Felor Badenberg — personal —, Berlin Senate Department for Justice, Salzburger Straße 21–25, 10825 Berlin. Berlin, 24.04.2025. Reference: IIIA9-4510-0027/2025/E.
Subject: Urgent appeal for help and political statement — Berlin as a synonym for absence of legal protection.
Dear Senator Dr. Badenberg, today I address this statement to you personally as a desperate citizen, a person subjected to political persecution and a person seeking full legal protection — because apparently there is no longer any functioning legal protection in Berlin.
I. Exhaustion of all legal remedies
I have done everything provided for by the legislature: submitted appeals on points of law and supplements in the prescribed form and within the time limits, written complaints and applications for supervisory review, and used the entire hierarchy of judicial instances. My submissions disappear, are disregarded, delayed or directly blocked.
II. Actors in the denial of legal protection
Presiding Judge Groß and the registry officials at Moabit Prison (JVA Moabit) refuse without grounds to take grounds of appeal on points of law on the record and forward them, disregard time limits and ignore applications.
III. Total isolation and blocking of mail
For weeks I have been completely cut off from the outside world: no access to letters, including official letters from courts and authorities, the Senate Department, the Federal Constitutional Court (Bundesverfassungsgericht) or the European Court of Human Rights (EGMR). The few letters that get through are opened, damaged or have disappeared.
IV. Politically motivated harassment
All of this is happening after I exercised my right to scrutiny and complaint before the highest courts and international bodies. The system’s response is not correction but repression and escalation.
V. Appeal to the Senator
Your office involves not only administrative power but also political and moral responsibility. I call on you: take personal responsibility for clarifying my case. End this deprivation of rights, this systematic disregard for fundamental rights, this isolation and intimidation.
With the deepest concern and the last hope of being heard, Dmitry Bagrash
Commentary — assessment by Dmitry Bagrash
This appeal was addressed personally to the Senator for Justice and received no personal reply. I record this because political responsibility for prison administration lies with the Senate, and because the same Senate Department later — according to Annex 84_F2 — appears as the prison’s coordination partner rather than its supervisor.
