Petition to the Petitions Committee of the German Bundestag

On 12.05.2025 I formally submitted a petition. It challenges German judicial and prison authorities’ targeted and systematic actions to deprive me of my rights, isolate me and wear me down. (Annex 37_F2)

Commentary — Dmitry Bagrash’s assessment

I received an acknowledgement of receipt, file reference: PET 4-21-07-99999-001649. For the first time this arrived properly, including in a sealed condition, under § 37 StPO.

Subject: Petition concerning systematic human rights violations, politically motivated persecution and serious violations of fundamental rights at JVA Moabit (Moabit Prison).

Dear Sir or Madam, I, Dmitry Bagrash, a remand prisoner at Justizvollzugsanstalt Moabit (Moabit Prison), hereby formally submit a petition. This petition challenges German judicial and prison authorities’ targeted and systematic actions to deprive me of my rights, isolate me and wear me down.

I. Systematic obstruction of my appeal on points of law proceedings (Revision)

Since submitting my supplement to the grounds for the appeal on points of law on 20 January 2025, I have received no acknowledgement of receipt required by law under § 37 StPO to date. The authority is deliberately delaying forwarding my defence documents.

II. Unlawful isolation and targeted psychological wearing down

Despite my constitutionally guaranteed right to freedom of religion under Art. 4 GG, I was denied any contact with the Jewish community for over 116 days.

III. Political persecution and targeted reprisals

The measures directed against me are evidently politically motivated. My work against Russian influence in Germany and my criticism of the illegitimate elections in Russia have led to targeted criminalisation.

IV. Systematic blocking of my right to be heard and sabotage of my defence

My submissions disappear, are ignored or are deliberately blocked. My correspondence is monitored, withheld or suppressed.

V. Unlawful inactivity of my court-appointed defence counsel

My court-appointed defence counsel does not respond to my enquiries. My application for his discharge, submitted on 17 December 2024, has been ignored to date.

VI. Lack of responses from the Senate Department for Justice

My repeated applications and complaints to the Senator for Justice, Dr. Felor Badenberg, remain unanswered. Instead of serious examination, my submissions are sent back to the bodies against which my complaints are directed.

VII. Demands

1. Immediate investigation of the systematic human rights violations by JVA Moabit, Groß, Presiding Judge at the Landgericht (Regional Court) (VRiLG), and the Berlin prosecution service. 2. Immediate decision on my application to discharge defence counsel. 3. Forwarding of my supplement to the grounds for the appeal on points of law without delay and issue of the acknowledgement of receipt under § 37 StPO. 4. Investigation of the political motivation behind my persecution. 5. Transparent disclosure of all measures taken against me.

VIII. Release from the duty of confidentiality

I expressly release the Petitions Committee from its duty of confidentiality in this matter.

IX. Personal meeting

Finally, I request the opportunity for a personal meeting with representatives of the Petitions Committee.
