Berlin Prosecutor General’s Office (Generalstaatsanwaltschaft Berlin)
On 15.07.2025 I received a reply from the Berlin Prosecutor General’s Office (Generalstaatsanwaltschaft Berlin) dated 01.07.2025. In this letter, Leitender Oberstaatsanwalt Dr. Brocke (Chief Senior Public Prosecutor) states that he found no procedural violations. The Bundesgerichtshof (Federal Court of Justice) had, he says, reached the same conclusion and dismissed my appeal on points of law (Revision) against the judgmentThe judgment of Berlin Regional Court (LG Berlin) of 22.07.2024 initially contained no list of the provisions applied (§ 260 Abs. 5 StPO). This was added only on 30.07.2025 — 373 days later and after the Federal Court of Justice (BGH) decision. of the Berlin Regional Court (Landgericht Berlin) of 07.05.2025. In his letter Dr. Brocke — as is, unfortunately, traditionally customary in the justice system — addresses none of the facts presented. (Anlage 89_F2)

How can the Prosecutor General’s Office simply give a blanket response to all my substantiated complaints against the Regional Court and against the Prosecutor General’s Office itself — without mentioning even one specific fact? Quite simply: all submissions are supposedly forwarded for “processing” — but in reality sent into a black hole. There they are either falsified or simply ignored. This makes it possible to claim at any time that everything was duly examined, while, as always, hiding behind the cover of an “ongoing investigation”.
The Prosecutor General’s Office functions like a black hole: everything disappears into it and nothing ever emerges. This is precisely what makes it possible to systematically misinform the media and evade any public scrutiny.

Dear Mr Bagrash, your letters of 26.03.2025 and of 9 and 24.04.2025 addressed to the Senate Department for Justice and Consumer Protection were forwarded to me by that Department insofar as they concern the handling of matters by staff at the Berlin Prosecutor General’s Office.
Following examination, I can identify no procedural violations. The Bundesgerichtshof reached the same conclusion, dismissing your appeal on points of law against the judgment of the Landgericht Berlin I by order of 07.05.2025.

Commentary — Dmitry Bagrash’s assessment
The Prosecutor General’s Office bases its finding that there was no procedural violation on the dismissal of my appeal on points of law by the Bundesgerichtshof. A decision whose manner of adoption I am precisely challenging is thus declared proof of its own correctness. This structure of circular reasoning recurs in almost all replies from supervisory authorities.
