Supplement to the constitutional complaint
On 19.08.2025, I prepared a supplement to the already pending constitutional complaint in which I particularly objected to the missing list of provisions in the judgmentThe judgment of the Berlin Regional Court (LG Berlin) of 22.07.2024 initially contained no list of the provisions applied (§ 260 Abs. 5 StPO). That list was inserted subsequently only on 30.07.2025 — 373 days later and after the Federal Court of Justice (BGH) decision. and the complete absence of information on legal remedies. This supplement was sent by post to the Federal Constitutional Court (Bundesverfassungsgericht) on the same day. (See Case 1.) Postal delivery on 22.08.2025 (RR 9152 2551 2DE)
Commentary — assessment by Dmitry Bagrash
The supplement concerns the point underpinning the entire proceedings: a judgment without a list of provisions and its subsequent supplementation after it became final. I expressly drew the Federal Constitutional Court’s attention to this before my complaints were decided.
