Administrative supervision complaint (Dienstaufsichtsbeschwerde) to the President of Berlin Regional Court (LG Berlin)

On 05.09.2025, I submitted an administrative supervision complaint (Dienstaufsichtsbeschwerde) to the President of Berlin Regional Court (Landgericht Berlin) (Littenstraße 12–17). Subject matter: the order of 30.07.2025 without information on legal remedies, the impermissible amendment of the operative part after finality and the absence of an acknowledgement of receipt for my immediate complaint of 26./27.08.2025 (RR98 2267909DE). Subject: Administrative supervision complaint concerning the order of the 22nd large criminal chamber (Schwurgericht — chamber for serious crimes) of Berlin Regional Court of 30.07.2025 — served on 07.08.2025 without information on legal remedies — and concerning the absence of acknowledgement of receipt of my immediate complaint of 26./27.08.2025 (case reference: 522 Ks 5/23; 176 Js 4/22 V).

I. Subject matter and facts

1. Order of 30.07.2025: the 22nd large criminal chamber “rectified” the judgment of 22.07.2024 by adding the list of applied criminal provisions for the first time. The order contains only the sentence “There is an obvious clerical error” as its reason. Information on legal remedies was absent. Receipt upon service on me: 07.08.2025.

2. Immediate complaint: on 26.08.2025, against this order, I made a submission within the time limit to Berlin Regional Court; postal forwarding took place on 27.08.2025 (tracking number: RR98 2267909DE). To date, I have no acknowledgement of receipt from the Regional Court.

3. The order of 30.07.2025 retrospectively interferes with the operative part of the judgment and was issued without a hearing. The absence of information on legal remedies made it impossible to comply with the time limit with certainty.

II. Objections under administrative supervision

1. Impermissible “rectification” after finality (substantive amendment of the operative part): The first inclusion of the entire list of provisions concerns the operative part and exceeds the scope of a mere correction of a clerical or transcription error. The chamber thereby made a substantive addition after finality.

2. Absence of information on legal remedies in the order of 30.07.2025: The omitted information meant that, as a detainee without legal representation, I could meet the time limits only amid considerable uncertainty.

3. Organisational and registry deficiencies: Despite the verifiable forwarding of my immediate complaint of 26./27.08.2025, to date I have received neither an acknowledgement of receipt nor a status notification. This conduct fits a repeatedly documented pattern of missing acknowledgements, refusals to accept submissions and delays in taking statements on the record.

IV. Applications under administrative supervision

1. Initiate an administrative supervision examination concerning the presiding/participating judges of the 22nd large criminal chamber and the responsible registry. 2. Immediately issue an official instruction to the registry to acknowledge receipt of my complaint promptly in writing, submit my written pleading for decision and provide me with a timely status update. 3. Secure the completeness of the case file. 4. Notify me of the result and measures within 14 days after receipt of this complaint.

The administrative supervision complaint to the President of the Regional Court concerned three points: the order of 30.07.2025 without information on legal remedies, amendment of the operative part after finality and the absence of any acknowledgement of receipt. This complaint was decided only on 09.07.2026 — after more than ten months (Chronology No. 168).
