Dmitry Bagrash, JVA Heidering (Heidering Prison), Ernst-Stargardt-Allee 1, 14979 Großbeeren — To Landgericht Berlin I (Berlin Regional Court I), registry of the 22nd major criminal chamber, Turmstraße 91, 10559 Berlin. Date: 17.09.2025.

Subject: Objection to delay under § 198 Abs. 3 GVG — inaction concerning my remedies against the order of 30.07.2025 (without information on legal remedies) — received by post on 27.08.2025, RR98 2267 909DE.

Dear Sir or Madam, I hereby object to the unreasonable delay in dealing with my remedies against the order of 30.07.2025, which subsequently supplemented the judgment of 22.07.2024 with the list of provisions applied. Receipt of my written submission by you on 27.08.2025 is evidenced. To date I have received neither an acknowledgment of receipt (§ 37 StPO) nor a case/file reference, no decision granting relief and no forwarding to the court of complaint.

Under § 198 Abs. 1 GVG I am entitled to have judicial proceedings concluded within a reasonable time; § 198 Abs. 3 GVG requires an objection to delay for this purpose. I hereby make that objection in the prescribed form and within the time limit. I request timely processing and notification within 14 days whether a) relief will be granted, or b) the matter will be forwarded immediately to the competent court of complaint under § 306 Abs. 2 StPO. I expressly reserve compensation claims under § 198 GVG.

Yours faithfully, Dmitry Bagrash

Commentary — assessment by Dmitry Bagrash

An objection to delay under § 198 Abs. 3 GVG is a mandatory prerequisite for subsequent compensation. I made it to keep the route to legal protection open, not to obtain money. The copies to the President of the Regional Court and to the Kammergericht served to preserve evidence.
