Declaration in lieu of oath (eidesstattliche Erklärung) “Deception 5”

In September 2025 I submitted a declaration in lieu of oath (“Deception 5”). Content: despite my efforts in December 2024 to have my court-appointed defence counsel Römer released from his duties and find new counsel with access to the case file for the , I did not succeed. To date I have had no access to the court record. During the trial OStR Wachs portrayed my political activity as insignificant, ruled out possible involvement of the Russian intelligence service, refused to summon witnesses and ignored OSZE (OSCE) reports. In September 2025 I also learned from a Russian press article (September 2023) that OStR Wachs had deceived the court. (Annex 75_F2)

I, Dmitry Bagrash, hereby declare in lieu of oath under § 294 Abs. 1 ZPO and all other applicable statutory provisions as follows:

1. Despite my efforts in December 2024 to have my court-appointed defence counsel, lawyer Römer, released from his duties, thereby find new counsel and obtain access to the case file to prepare a precise supplement to the grounds of appeal on points of law, I did not succeed. To date I have also not obtained access to the complete court record.

2. Throughout the criminal proceedings, particularly during prosecutor OStR Wachs’s “last word”, my political activity against the Putin regime was portrayed disparagingly and described as being of “very low significance”.

3. OStR Wachs repeatedly stated that possible involvement of the Russian intelligence service in a provocation directed against me must be ruled out because — according to his argument — the Russian intelligence service would necessarily have informed the German authorities of my name if I had been the person alleged to have placed the USBV under the villa on Leipziger Straße.

4. OStR Wachs repeated this argument several times. In this connection he refused to summon a representative of the Verfassungsschutz (constitutional protection authority) as a witness, declined to consider OSZE reports No. 519702 of 02.04.2022 and No. 499582 of 24.09.2021, and mockingly commented that my references — for example to the arson attack on my car — were an expression of “madness”.

5. OStR Wachs expressly stated that no information from the police or other investigating authorities existed about my name as that of a suspected perpetrator, and he therefore ruled out a possible provocation by the Russian intelligence service.

Conclusion: As a result of OStR Wachs’s actions, possible involvement of the Russian intelligence service was not seriously examined either during the investigation or during the trial.

Addendum: In September 2025 I learned from an article in a Russian newspaper (published in September 2023) that OStR Wachs had deceived the court by untruthfully stating that there had been no information from the FSB to the police concerning my name.

I hereby affirm that the statements above are true and that I have made them to the best of my knowledge and conscience. Notice: I am aware that a false declaration in lieu of oath may have consequences under criminal law (§ 156 StGB, § 163 StGB).

Commentary — assessment by Dmitry Bagrash

This declaration in lieu of oath places the events concerning a change of counsel and access to the case file in the “Deception” series. A declaration in lieu of oath under § 156 StGB carries criminal penalties: I bear full criminal responsibility for every word. That is precisely why this format was chosen.
