StVK) concerning the lack of a response to the appeal on points of law
On 02.03.2026 I sent a status inquiry by fax to the Landgericht Berlin I (Berlin Regional Court I; 99th Sentence Enforcement Chamber, case reference 599 StVK 215/25 Vollz), requesting written confirmation of receipt and information on whether and when my appeal on points of law (Rechtsbeschwerde), lodged on 13.01.2026 by having it recorded at the AG Zossen (Zossen Local Court, case reference 131 AR 1/26), and the application for leave to bring that appeal had been forwarded or submitted to the Kammergericht (Berlin Higher Regional Court). At the same time, as a precaution I raised a formal objection to delay (Verzögerungsrüge) under § 198 Abs. 3 GVG and demanded immediate information on the status of the proceedings, particularly the receipt date, the status of submission or forwarding and the Kammergericht case reference. Dear Sir or Madam, on 13.01.2026 I lodged an appeal on points of law against the Landgericht Berlin I order of 10.12.2025 by having it recorded at the registry of Amtsgericht Zossen, and at the same time applied for leave to bring the appeal. To date I have received no written information on receipt, the processing status or any submission or forwarding to the Kammergericht.
I therefore request: 1. Written confirmation of receipt of the appeal on points of law and the application for leave, including the receipt date. 2. Information on whether and when the appeal, together with the case file, was submitted or forwarded to the Kammergericht; if this has already happened, the case reference assigned there. 3. In the alternative, if submission has not yet occurred, immediate submission or forwarding and written confirmation of this.
I draw attention to the fact that the lack of information on the status of the proceedings impairs my right to effective judicial protection (Art. 19 Abs. 4 GG) in practice. Without a case reference and information on the status of the proceedings, I cannot take appropriate further steps or reliably monitor time limits.
Formal objection to delay under § 198 Abs. 3 GVG: As a precaution, I raise a formal objection to delay because of what I consider to be no longer acceptable inactivity in the processing and forwarding of my appeal on points of law lodged on 13.01.2026. I ask for the matter to be expedited and for immediate written information on the status of the proceedings.

Seven weeks after the appeal was recorded, neither a confirmation of receipt nor a submission date was known. The status inquiry by fax begins a chain of four reminders with transmission reports. Without a case reference at the court hearing the appeal on points of law, the person concerned cannot verify whether their legal remedy exists at all.
