Receipt of the Bundesverfassungsgericht (Federal Constitutional Court) order declining to accept the complaint without reasons (Nichtannahmebeschluss)

On 28.04.2026 I received the Bundesverfassungsgericht order of 13.04.2026 concerning my constitutional complaint against the Kammergericht Berlin (Berlin Higher Regional Court) order of 31.10.2025 — 3 Ws 48/25, 3 Ws 49/25 — and the Landgericht Berlin (Berlin Regional Court) order of 30.07.2025 — 522 Ks 5/23. The Bundesverfassungsgericht stated only that the constitutional complaint would not be accepted for decision under § 93b in conjunction with § 93a BVerfGG. The decision was described as not subject to appeal.

The accompanying letter gives the Bundesverfassungsgericht case reference as 2 BvR 199/26. The order contains no substantive reasons explaining why my constitutional complaint was not accepted for decision.

Commentary — assessment by Dmitry Bagrash

My constitutional complaint was thus not accepted for decision without any reasons being given. Particularly in light of the challenged failure to forward my complaint, the absence of effective legal protection, the missing Kammergericht case reference and the subsequent “correction” of the criminal judgment, I still cannot understand what constitutional review took place at all.
