Summons to the two-thirds hearing under § 57 StGB
On 04.06.2026 the Landgericht Berlin I (Berlin Regional Court I), sentence enforcement chamber, issued a summons in case 589 StVK 86/26 to an oral hearing on suspension of the remainder of the sentence on probation (Aussetzung des Strafrests zur Bewährung) under § 57 StGB. The summons was handed to me on 08.06.2026. The hearing is scheduled for 24.06.2026 at 9:30 at Turmstraße 91, Berlin.
The summons letter states that the Generalstaatsanwaltschaft (Prosecutor General’s Office) opposed early release. The Generalstaatsanwaltschaft’s observations themselves were not provided to me.

Commentary — assessment by Dmitry Bagrash
Withholding the prosecution’s observations constitutes a violation of the requirement to afford the right to be heard under Art. 103 Abs. 1 GG and of the requirements of § 454 Abs. 1 S. 3 StPO. By letter of 10.06.2026 (Annex 125_F2), sent by fax, I requested that the Generalstaatsanwaltschaft’s observations and all other documents relevant to the decision be provided to me before the hearing.
