Subsequent sending of the previously missing page of the statement of the Prosecutor General’s Office (Generalstaatsanwaltschaft)
Before the hearing of 24.06.2026, Annex 132_F2 sent to me contained only an incomplete version of the statement of the Prosecutor General’s Office (Generalstaatsanwaltschaft) of 26.05.2026: the first page of the prosecutor’s reasons was followed immediately by the concluding page. The intervening second page was missing. The statement of 26.05.2026 is signed by Staatsanwalt/GL (Public Prosecutor/GL) Lazarenko (Berlin Prosecutor General’s Office — Generalstaatsanwaltschaft Berlin, 176 Js 4/22 V). The covering letter of the Berlin Regional Court I (Landgericht Berlin I) of 10.07.2026 is signed by JSekr’in Sohn (judicial secretary), registry officer.
Only on 14.07.2026, exactly 20 days after the hearing and the refusal decision, did I receive the complete version with Annex 148_F2.
On the previously missing page, the Prosecutor General’s Office alleges that no “reflection on the offence” (“Tataufarbeitung”) has taken place and that I am driven by strong anger, a pronounced sense of grievance and an explicitly expressed “urge for retribution”. At the same time, it acknowledges that a comprehensive admission of guilt is not an indispensable requirement and that denial of the offence alone cannot support an adverse social prognosis. Nevertheless, it is precisely the failure to acknowledge the offence that is substantively used against my release.
Note: Annex 132 ends on the first page of the reasons in the middle of the word “Persönlichkeit” (“personality”), then continues with the later concluding page.
Commentary — Dmitry Bagrash’s assessment
Before the hearing I could neither respond to these serious assertions nor present contrary evidence. The decision on my liberty was thus based on an adverse page withheld from me before the hearing. The incident also confirms the practical pressure to induce me, regardless of what I actually believe, to “reflect on the offence” and thereby acknowledge it.
