Statement of the Prosecutor General’s Office (Generalstaatsanwaltschaft) on the immediate complaint (sofortige Beschwerde)
On 21.07.2026 I received a letter from the Berlin Higher Regional Court (Kammergericht) in proceedings 2 Ws 111/26, with a two-week opportunity to make representations. Enclosed was the statement of the Prosecutor General’s Office (Generalstaatsanwaltschaft) of 14.07.2026. The Prosecutor General’s Office described my immediate complaint as admissible but requested its rejection as unfounded.
There was no independent examination of my specific complaints. The Prosecutor General’s Office merely referred in general terms to the reasons for the Regional Court (Landgericht) order of 24.06.2026.
Commentary — Dmitry Bagrash’s assessment
Neither the incomplete sending of the case file nor the delayed disclosure of the JVA statement, exclusion of the press or my complaint alleging violation of the right to be heard was addressed substantively. The alleged procedural violations again went unanswered.
