The prison explains the five days: visual inspection with no issues found

In response to my fax of 24.08.2026, Heidering prison (JVA Heidering) states that the postal items concerned could not be delivered immediately because of a visual inspection for prohibited objects by the Security Department. The inspection was carried out under § 36 StVollzG Berlin, the prison says. There had been “no issues whatsoever in this respect”.

Delays may arise during such an inspection; the prison asks for understanding for the late delivery and undertakes to ensure processing as swiftly as possible in future. It forwards my request for an immediate appointment with the court registry officer who records procedural declarations (Urkundsbeamten) to prison unit 1 (Teilanstalt).

Commentary — assessment by Dmitry Bagrash

I acknowledge that the prison admits what happened, apologises and promises remedial action. That is more than I have experienced in other proceedings.

What remains is the arithmetic: An inspection that found no issues took five days while a time limit for a legal remedy was running. The item contained the draft of my appeal on points of law (Rechtsbeschwerde). I do not know, and do not allege, whether the prison knew what was in the envelope.
