31.07.2026, received 11.08.2026. The Berlin Regional Court I (Landgericht Berlin I) rejects my application under §§ 109 ff. StVollzG challenging the sentence and reintegration plan, the refusal of open prison conditions and the refusal of relaxations of prison conditions. The order states that the legal-protection measures I documented were not scanned or reviewed and were not made a basis of the decision; their details were not relevant to the decision under § 109 StVollzG.
30.07.2026, received 05.08.2026, 19:20. The court forwards to me the statement of Heidering prison (JVA Heidering) of 28.07.2026 concerning the blocking of video calls, together with annexes, and asks me to take note of it and, if appropriate, submit a final response within three weeks. The prison requests the rejection of my application.
18.08.2026, received 20.08.2026. The court forwards to JVA Heidering a copy of my amended application of 14.08.2026 for a judicial decision and — in view of the amended requests and additional urgent application — asks for a response within one week. A copy of this letter was sent to me.
Commentary — Dmitry Bagrash’s assessment
The third matter is the most important: the court has set the prison a one-week time limit. The proceedings concerning the blocking of video calls are therefore active, while the ban itself runs until 16.10.2026.
As to the first matter: an order expressly stating that the documented legal-protection measures were not reviewed decides on a sentence plan that uses those very measures as the basis for a risk of abuse.
