Complaint to the Senate Department under substantive administrative supervision (Fachaufsichtsbeschwerde) concerning the video-call ban
Alongside the complaint concerning official conduct (Dienstaufsichtsbeschwerde), I address a complaint under substantive administrative supervision (Fachaufsichtsbeschwerde) to the Senate Department for Justice and Consumer Protection (Senatsverwaltung für Justiz und Verbraucherschutz). The original ban no longer needs to be set aside; the Regional Court has already done so. Its subject is a substantive examination of the grounds for the decision and the question of what organisational and legal consequences are drawn from the order.
Among other things, the complaint asks about the rule relied upon, the establishment of the facts, the consideration of less restrictive measures and what significance may legitimately be attached to refraining from public publications for access to video calls.
