Phone charges doubled, prison silent for eight weeks: application to the enforcement chamber
30.10.2026 · zugestellt 29.10.2026
Since 17 August 2026 the operator of the in-cell media system, the Telio group, has charged higher per-minute prices: calls to German mobile networks cost 0.04 instead of 0.02 euros (+100 %), abroad up to 0.19 instead of 0.02 euros (+850 %); German landlines stayed at 0.03 euros. Prisoners cannot change provider or tariff. Despite two reminders, JVA Heidering has not even acknowledged my application of 3 September 2026 (received 6 September 2026). In an application under §§ 109, 113 StVollzG I ask the enforcement chamber to order the prison to decide.
The Federal Constitutional Court requires the prison to ensure market prices where prisoners have no alternative telephone provider (order of 8 November 2017 – 2 BvR 2221/16). The Federal Cartel Office wrote to me: “Ultimately, it is a matter for the Land/the prison” (B11-1/26-043). The Senate Department forwarded my parallel request to a specialist officer on 10 September 2026 (Anlage 220_F2) and has not decided since. Delivered by fax on 29 October 2026 at 22:38 to 030 9014-2010, 6 pages, transmission OK, FAX-ID 17698015 (Anlage 263_F2). Annexes: Anlage 262_F2, Anlage 220_F2. No decision has been taken on the application; the assessments are mine.
