Application for a deadline extension and access to the case file
On 10.12.2024 I applied for a court decision extending the deadline for supplementing the grounds for the appeal on points of law (Revision)The grounds for the appeal on points of law against the judgment of 22.07.2024, submitted by court-appointed defence counsel on 28.11.2024. and applied for access to the case file, as contact with my defence counsel had been impossible for months. I received no acknowledgement of receipt under §37 StPO
First official response: on 21.05.2025 I received a response from a court for the first time — the order of the BGH (Federal Court of Justice) dated 07.05.2025 (148 days later)
Amtsgericht Tiergarten (Tiergarten Local Court) at JVA Moabit (Moabit Prison). Bagrash, Dmitry, register number 2796/22/6, appeared. Berlin, 10.12.2024.
I would like to add the following concerning my appeal on points of law: my lawyer Römer has been unable since September to consult with me about the grounds for the appeal in order to substantiate it. I could not reach him, nor was he (any longer) available to me.
I also apply for access to the case file, because in my view the assessment of the evidence is contradictory and flawed, and my appeal on points of law has therefore not been properly carried out. The judgment contains contradictory and insufficient findings of fact that must be substantiated, or the contradictions between the grounds of the judgment and the case file must be explained under § 337 StPO.
As a precaution, I also apply for an extension of the deadline. I previously had two lawyers assigned to me who were discharged from their duties as defence counsel. I can now no longer obtain the relevant information through another lawyer.
