Supervisory complaint: Senate Department asked to review the Prosecutor General’s refusal to transfer
22.10.2026
In a letter of 22 October 2026 I lodge a supervisory complaint with the Senate Department for Justice as the supervisory authority (§ 147 No. 2 GVG) against the Prosecutor General’s decision of 14 October 2026 not to transfer proceedings 232 Js 4326/26. Requests: review by way of supervision; examination of a transfer by agreement with another Land justice administration; alternatively an assurance that neither in the investigation nor on a complaint under § 172(1) StPO will officials decide who took part in my case, belong to senior prosecutor Wachs’s department or are his superiors; notice whether the case is a reporting matter; a decision of its own instead of forwarding to the Prosecutor General’s Office. Delivered by fax on 21 October 2026 at 23:20, 18 pages, transmission OK. Sources: Anlage 242_F2, transmission report Anlage 244_F2.
Grounds given in the letter: the Prosecutor General’s Office decided in its own cause; its reasoning misses my request; the further path (§ 172 StPO) leads back to it; both accused acted one after the other in the same matter in 2024 (Case 3); the same office closed the complaint against detective Weiß after 533 days. My letter to the Senate Department of 12 October 2026 is still unanswered. The presumption of innocence applies to the accused. Earlier: F2-221.
