I received the letter from the Prosecutor General’s Office dated 29 September 2026 in prison and read it aloud twice over the telephone. Anlage 224_F2 is the transcription made in this way, not a scan. The scan of the original will be added and will then take precedence.

Sehr geehrter Herr Bagrash,
Ihre Eingabe vom 2. September 2026 habe ich zuständigkeitshalber der Staatsanwaltschaft Berlin zur weiteren Bearbeitung zugeleitet, der ich Ihre Eingabe vom 29. September 2026 ebenfalls übermittle.
Ein Aktenzeichen der Staatsanwaltschaft Berlin ist hier noch nicht bekannt.
HochachtungsvollTranslation: “Dear Mr Bagrash, for reasons of jurisdiction I have forwarded your submission of 2 September 2026 to the Berlin Public Prosecutor’s Office for further processing, to which I am also transmitting your submission of 29 September 2026. A case number of the Berlin Public Prosecutor’s Office is not yet known here. Yours faithfully”
What it says — and what it does not
- It says: referral “for reasons of jurisdiction” to the Berlin Public Prosecutor’s Office.
- It does not say a word about my request for an examination outside Berlin.
- It does not say who decided on that request.
- It gives no case number of the Berlin Public Prosecutor’s Office.
- Time taken: 27 days from the complaint to these three sentences, another 8 days to reach me.
Why the referral does not answer the question
Senior prosecutor Wachs prosecuted me as an official of the Berlin Prosecutor General’s Office. The Berlin Public Prosecutor’s Office, to which the complaint was sent, is under the supervision and direction of the Prosecutor General’s Office (§ 147 no. 3 GVG); its officials must follow its instructions (§ 146 GVG). The complaint against a prosecutor of the Prosecutor General’s Office therefore lies with an authority to which the Prosecutor General’s Office can give instructions.
