Case 2 — Criminal complaint Groß/Wachs

Anlage 241_F2 — Letter from the Berlin Prosecutor General’s Office of 14 October 2026 (scan)

What it is: Scan of the letter of the Berlin Attorney General’s Office, ref. 163 AR 392/26, of 14 October 2026 (production date 19 October 2026), received on 21 October 2026; signed “Scheinichen, Leitende Oberstaatsanwältin”, certified. Subject: “Your submission of 12 October 2026 by fax” – my follow-up letter Anlage 226_F2. The scan replaces the earlier transcription from dictation.

What it says: the Berlin Public Prosecutor’s Office has opened proceedings on my complaint of 2 September 2026 under case number 232 Js 4326/26. “Allein die Tatsache, dass sich das Verfahren gegen Justizbedienstete des Landes Berlin richtet, bietet für sich genommen keinen Anlass, das Verfahren an eine auswärtige Staatsanwaltschaft abzugeben” (“The mere fact that the proceedings are directed against judicial employees of the Land of Berlin does not in itself give reason to transfer them to a prosecutor’s office elsewhere”).

What is missing: I did not ask for a transfer because the accused are Berlin judicial employees, but because senior prosecutor Wachs prosecuted me as an official of this very Prosecutor General’s Office — the office that has now decided on the transfer itself and to which any complaint under § 172(1) StPO returns. The letter does not address this. The presumption of innocence applies to the accused.
