Two demands in one petition

The petition opposes the threatened deportation of Dmitry Bagrash to the Russian Federation and also calls for an independent review of the documented procedural defects in his criminal trial. It thus brings together two aspects closely connected in this case: protection against deportation under Art. 3 EMRK and the UN Convention against Torture, and investigation of the procedural defects (the missing chain of legal provisions in the judgment, unsigned decisions, and late transmission of the case files before the hearing on 24.06.2026).

Important — as the petition itself states: The signatories expressly state that Dmitry Bagrash's allegations (falsification of the judgment, the role of Judge Groß and Senior Public Prosecutor Wachs (OStA)) are not regarded as proven in advance. The demand is for an independent, transparent review — not confirmation of the allegations themselves.

What the petition specifically calls for

  • No deportation to Russia — given the publicly documented political activity against the Putin regime, there is a threat of persecution, torture and danger to life there.
  • Immediate and complete access to the case files — including all current submissions by the prosecution service.
  • Lawful criticism, complaints and video messages must not be used against him as evidence of a lack of “rehabilitation”.
  • A comprehensive investigation of the documented defects in the records and judgment, missing signatures on judicial documents and the unexplained intelligence-service lead.

As evidence of the political background, the petition refers, among other things, to two OSCE documents that explicitly describe the work of Unkremlin e.V. as “hostile from the Russian perspective”, and to the designation of the association as an “undesirable organisation” by the Russian Prosecutor General's Office (2023).

Scientific risk assessment: individual risk in the event of deportation

On 2 July 2026, the International Association “Institute for National Policy” (Kyiv, identification code: 41941956, document no. IA-INP/SG-2026-001) produced a scientific and practical expert report on the individual risk assessment for Dmitry Bagrash in the event of transfer to the Russian Federation.

The report expressly assesses not the general human rights situation in Russia in isolation, but the cumulative effect of individually documented risk factors: public visibility as an activist critical of the regime, the activities of Unkremlin e.V. (designated by Russia as an “undesirable organisation”), and the naming of the organisation in official OSCE statements by the Russian delegation.

Conclusion of the report (paraphrased with its wording retained): Following an assessment of all documented sources of information, there are substantial indications that, in the event of transfer, Dmitry Bagrash would not be treated as an ordinary returnee but, because of his documented public political profile, could be exposed to an increased risk of state repression. A particularly careful, individualised human rights assessment appears necessary.
