Status enquiry to the Federal Constitutional Court (Bundesverfassungsgericht) — 48 days of silence

On 27.08.2026, I signed a status enquiry to the Federal Constitutional Court (Bundesverfassungsgericht) (Annex 190_F2). Transmission by fax is forthcoming; the transmission evidence will be supplied later.

Occasion: On 10.07.2026, I filed a constitutional complaint within the time limit against the order of the Berlin Higher Regional Court (Kammergericht Berlin; case reference 5 Ws 17/26, 12.06.2026) and two orders of Berlin Regional Court I (Landgericht Berlin I; case reference 599 StVK 215/25 Vollz, 04.11.2025 and 10.12.2025) — with 17 annexes, by fax; transmission evidence is available. No case reference had yet been assigned when it was filed.

The finding: 48 days after filing, there is neither an acknowledgement of receipt nor notification of a case reference. In my own experience, the court usually replies within a few working days with a provisional case reference.

The status enquiry asks for prompt notification of whether the complaint was received and the case reference under which it is being handled, and for confirmation of receipt in text form. In the event of a delivery error, it offers to resend all documents immediately.

Commentary — assessment by Dmitry Bagrash

I do not claim that silence for 48 days is unlawful in itself — processing times of several weeks are not unusual in complex proceedings, and the absence of an acknowledgement of receipt says nothing about the prospects of success. I document only the passage of time: the filing date, transmission evidence and the lack of a response so far — as a fact, not an accusation.

Status update reference of 26.09.2026

The gap in communication that existed when this entry was written has now been closed: by letter of 01.09.2026 (Annex 207_F2), received by me on 07.09.2026, the Federal Constitutional Court confirmed receipt of the constitutional complaint of 10.07.2026 and notified me of the case reference 2 BvR 1314/26 — see Chronology No. 199. The decision on the merits itself is still pending.
