Prosecutor General’s Office: case number 232 Js 4326/26 – transfer outside Berlin refused

14.10.2026

In a letter dated 14 October 2026 (ref. 163 AR 392/26; produced 19 October 2026; received by me on 21 October 2026) the Berlin Prosecutor General’s Office replies to my follow-up letter of 12 October 2026. The Berlin Public Prosecutor’s Office has opened proceedings on my complaint of 2 September 2026 under case number 232 Js 4326/26. On my request for a transfer: “Allein die Tatsache, dass sich das Verfahren gegen Justizbedienstete des Landes Berlin richtet, bietet für sich genommen keinen Anlass, das Verfahren an eine auswärtige Staatsanwaltschaft abzugeben” (“The mere fact that the proceedings are directed against judicial employees of the Land of Berlin does not in itself give reason to transfer them to a prosecutor’s office elsewhere”). Signed by a Leitende Oberstaatsanwältin (chief senior prosecutor) of the Prosecutor General’s Office. Source: Anlage 241_F2 (transcript).

The Prosecutor General’s Office has thus decided on my request — itself. I had not based the request on the accused being Berlin judicial employees, but on the fact that senior prosecutor Wachs prosecuted me as an official of this very Prosecutor General’s Office, and that any complaint against a discontinuation under § 172(1) StPO goes back to it. The letter addresses neither reason. On the dates: the letter is dated the day after my press release of 13 October 2026 and two days after the supplement to my Bundestag petition; it was produced five days later and reached me after seven days. I do not claim a connection; I record the dates. The presumption of innocence applies to the accused. Earlier: the first reply of 29 September 2026 (F2-210) and the follow-up letters of 12 October 2026 (F2-212).
