Dmitry Bagrash, chair of the association Unkremlin e. V., has published at bagrash-justice.com a complete record of his criminal and sentence enforcement proceedings. All official documents can be viewed in their original form. On 2 September 2026, he filed a criminal complaint under § 339 StGB against the presiding judge and the senior prosecutor in his proceedings. No decision has been made on the allegation; the presumption of innocence applies.

Bagrash, in Germany since 1992 and founder of the Russian-language anti-war association Unkremlin, has been in prison since December 2022. Two thirds of his sentence have been served since 5 July 2026. Suspension of the remainder of the sentence was refused.

The documentation comprises about 770 pages and 320 dated events. It includes orders, sentence plans, statements and transmission records in full. For each event, it expressly includes the exculpatory interpretation and identifies the evidence that is missing.

Three events that can be checked against the documents

The judgment of the Landgericht Berlin I of 22 July 2024 entirely lacked the list of applied provisions required by § 260 Abs. 5 StPO. The Bundesgerichtshof (Federal Court of Justice) decided on this version on 7 May 2025. The list was inserted on 30 July 2025, 373 days after pronouncement and after the judgment had become final, on the grounds that there had been an obvious clerical error. The court composition issuing the correction order differed from that issuing the judgment. Annex 65_F2

A diagnostic procedure at JVA Moabit (Moabit prison) in April 2026 produced an LSI-R score of 20, which the document describes as a below-average risk of reoffending. This figure does not appear in any subsequent decision. Instead, wording about a “clearly expressed urge for retribution” passes verbatim through five official documents, without a single item of evidence being identified. The document bears no signature. Since 17 July 2026, Bagrash has been banned from video calls for three months. On 25 August 2026 the prison informed the Landgericht in writing that at the hearing he had “not taken the opportunity to refrain from this type of use of video calls in future”, and inferred from this that a total ban was the least restrictive measure. To date, he has not been told which provision he is alleged to have violated. In its own payslip for August 2026, the same prison lists “journalist” twice. Annex 205_F2 · 206_F2

Status of proceedings

The constitutional complaint (Verfassungsbeschwerde) of 10 July 2026 was registered at the Bundesverfassungsgericht (Federal Constitutional Court) under case reference 2 BvR 1314/26. A second constitutional complaint of 1 September 2026 has no case reference. A complaint has been filed with the European Court of Human Rights. A petition is before the Petitionsausschuss des Abgeordnetenhauses von Berlin (Petitions Committee of the Berlin House of Representatives).
