Complaint against its own prosecutor: Berlin Prosecutor General’s Office hands it to its own subordinate office — Bagrash turns to the Bundestag

On 2 September 2026 Dmitry Bagrash filed a criminal complaint under § 339 StGB with the Berlin Prosecutor General’s Office against the presiding judge of the Regional Court, Groß, and senior prosecutor Klaus-Michael Wachs. Wachs had prosecuted Bagrash as an official of this very Prosecutor General’s Office. On page 1 Bagrash therefore asked for the matter to be transferred to a prosecution office outside Berlin. Instead, the Prosecutor General’s Office handed the complaint to the Berlin Public Prosecutor’s Office, which is under its supervision — without a case number, without a word on the transfer request, and only on the day of a status enquiry, after 27 days of silence. Since yesterday the matter has been before the Petitions Committee of the German Bundestag.

The chronology

The structure

The Prosecutor General’s Office has the right of supervision and direction over the officials of the Berlin Public Prosecutor’s Office (§ 147 no. 3 GVG); they must follow its instructions (§ 146 GVG). If the Berlin Public Prosecutor’s Office drops the case, any complaint under § 172(1) StPO goes back to the Prosecutor General’s Office — the office for which Wachs prosecuted. The subsequent application to court must be signed by a lawyer (§ 172(3) StPO). Bagrash is in prison and has none.

A year earlier: the same formula

On 23 September 2025 the Berlin Regional Court forwarded a status enquiry from Bagrash to the Prosecutor General’s Office instead of submitting his appeal to the Kammergericht — no case number existed there. On 29 September 2026 the Prosecutor General’s Office writes: “A case number of the Berlin Public Prosecutor’s Office is not yet known here.”

“I expressly asked that the office of my prosecutor should not decide on the complaint against him. The answer was a referral to its own subordinate office — only on the day I asked, and without a word on my request. Who is examining whom here? I am now putting this question to the Bundestag, because the law does not answer it.” — Dmitry Bagrash

What Bagrash demands

Questions editors can put to the authorities

  1. Under which case number is the Berlin Public Prosecutor’s Office handling the complaint of 2 September 2026?
  2. Who decided on the request to transfer the matter outside Berlin, and on what grounds?
  3. Why is the notice of referral dated the day of the status enquiry, 27 days after receipt?
  4. How many complaints of perversion of justice against Berlin judges and prosecutors have been handled outside Berlin since 2020?

The allegations in the complaint are Bagrash’s account; no decision has been made on them, and the persons named are presumed innocent. The sequence of referrals is documented by the linked documents. The letter of 29 September 2026 exists as a dictated transcription; scanning is currently not possible at Heidering prison.
